Being both an attorney and a Certified Public Accountant, Mark L. Van Buskirk brings a unique understanding and substantial skills to representing businesses in litigation involving breaches of contract, business torts, and various other commercial transactions and relationships.
At some point you are likely to encounter a business dispute. If the dispute cannot be resolved through negotiations, your remaining option is to resolve the issue through litigation.  Knowing that litigation is generally expensive, can negatively impact day-to-day operations, overall productivity, and goodwill in the industry, Mr. Van Buskirk works to resolve business litigation as quickly and efficiently as possible while working toward vindicating the client’s interests.
By involving an attorney early in the dispute, you have the best opportunity to resolve the issues with the least financial cost and time investment. If business litigation is required, the firm provides an objective analysis and effective, cost-conscious legal representation of either plaintiffs or defendants from the beginning of the litigation through its conclusion.
Breach of Contract:  A contract, whether written or oral, is the basis of every business transaction. When that contract is breached, the non-breaching party may be entitled to recover for the direct and consequential damages of that action, force the other party to perform, or seek other appropriate remedies. There are defenses to a breach of contract action, and specific rules apply to determine what type of evidence is allowed to prove the validity or proper interpretation of the contract.
Business Torts:  Claims of fraud, misrepresentation, and other civil causes of action may also result in liability and, in some instances, may include punitive damage awards. Business torts include: fraud; negligent misrepresentation; unfair business practices; deceptive trade practices; defamation
Business Dissolution, Shareholder Disputes and Partnership Disputes: At times disputes arise between business owners or competing factions of shareholders. Claims of breach of fiduciary duties are often present and may result in the equivalent of a business “divorce.”  Being both an attorney and a certified public accountant, Mr. Van Buskirk is in a unique position to understand business relationships and the most appropriate avenues to resolve the dispute by either a negotiated settlement or by litigation.
Employment Disputes: Mr. Van Buskirk represents various business interests against employee claims of: wrongful termination; termination in violation of the law or a valid employment agreement; wrongful termination based on physical or mental disability, medical condition, pregnancy, gender, race, sexual orientation or age; discrimination claims based upon race, religion, gender, national origin, disability, sexual orientation, medical condition, physical or mental disability, pregnancy or age; sexual harassment; wage and hour violations; violation of state and federal labor laws; retaliation; and failure to provide clothing, equipment or failure to reimburse employees.
Mr. Van Buskirk is a seasoned attorney, having exclusively practiced in the civil litigation arena since becoming licensed as an attorney in 1997.  He has successfully represented clients before the California Supreme Court as well as the California Court of Appeal.
